1. Introduction

These Terms of Use govern your access to and use of the Senderwe website, applications (including Mail Send and WhatsApp Send), related software, and related services (collectively, the "Services").

"Senderwe" is a communication software platform created and developed by SYNTR.AI (hereinafter referred to as "we", "us", or "our").

"User" or "Customer" refers to the individual or business entity accessing or purchasing the Services.

2. Acceptance of Terms

By accessing the website, purchasing a plan, downloading or using the software, or otherwise using the Services, you agree to be bound by these Terms and any related policies (including our Privacy Policy and Refund Policy).

If you do not agree to these Terms, you must not access or use the Services.

3. Eligibility

You must have the legal capacity required under applicable law to enter into these Terms. By using the Services, you represent that you meet all legal requirements to form a binding contract.

4. Account Registration

Depending on the product, you may be required to register an account or receive a license key to access the Services. You agree to provide accurate, current, and complete information during the registration or checkout process.

You are responsible for:

• Safeguarding your account credentials and license keys.
• Maintaining the security of your account and local software installations.
• All activities that occur under your account or license key.

You must notify us immediately if you believe your account or license has been compromised.

5. Senderwe Products

Senderwe provides communication software applications, currently including:

Mail Send

Software for configuring SMTP profiles, managing local contacts, creating email templates, launching campaigns, and monitoring results directly from your local machine.

WhatsApp Send

Software for WhatsApp communication and related automation workflows.

Product availability and features may vary depending on the plan purchased.

6. Acceptable Use

You agree to use Senderwe legally and responsibly. You are strictly prohibited from using the Services for:

• Sending illegal, fraudulent, or phishing communications.
• Distributing malware or malicious content.
• Impersonation, harassment, or issuing threats.
• Deceptive communications or unauthorized access to third-party accounts.
• Abusing third-party services or circumventing their technical restrictions.
• Infringing upon intellectual property rights.

Email Sending Restrictions

When using Mail Send, you are strictly prohibited from:

• Sending unauthorized spam or unsolicited bulk email.
• Using purchased, rented, or illegally obtained contact lists.
• Harvesting email addresses automatically.
• Sending to recipients without an appropriate lawful basis or required consent under applicable anti-spam laws (e.g., CAN-SPAM, GDPR).
• Using misleading sender identities or deceptive subject lines.

WhatsApp Restrictions

When using WhatsApp Send, you must comply with applicable WhatsApp/Meta terms of service and all applicable laws. Senderwe does not claim to bypass WhatsApp platform restrictions, account bans, rate limits, or enforcement policies.

7. User Content & Responsibility

You are solely responsible for any content you upload, import, create, send, store, or process through Senderwe, including but not limited to:

• Contact lists, email addresses, and phone numbers.
• Email content, templates, and WhatsApp messages.
• Campaign configurations.

You represent and warrant that you have all necessary rights, permissions, and lawful bases to use personal data and send communications through our Services.

8. Third-Party Services

Senderwe applications (like Mail Send) are designed to interact with third-party services such as your chosen SMTP providers (e.g., Google, Amazon SES, SendGrid) or WhatsApp/Meta networks.

You acknowledge that:

• Your use of third-party infrastructure is subject to those providers' terms and policies.
• Senderwe does not control third-party services, nor are we responsible for their availability, account suspensions, deliverability rates, or policy enforcements.

9. Payments & Subscriptions

Senderwe currently operates on a direct-purchase licensing model. Pricing for software licenses is clearly displayed before purchase.

• Payments are processed securely prior to license issuance.
• Once a license period expires, you must purchase a new license or renewal to continue using the premium features of the software. We do not automatically charge your payment method for renewals unless explicitly configured and agreed to by you in the future.
• All purchases are subject to our Refund Policy.

10. Intellectual Property

The Senderwe software, website, branding, logos, designs, source code, and documentation are owned by or licensed to SYNTR.AI, except for explicitly identified third-party materials.

You receive only the rights necessary to use the Services according to these Terms. You do not receive ownership of the software.

11. User License

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Senderwe applications for your internal business purposes during your purchased plan duration.

You may not reverse-engineer, decompile, or attempt to extract the source code of the Senderwe applications.

12. Suspension & Termination

We reserve the right to suspend or terminate your access to the Services, or revoke your software license, immediately and without notice if we reasonably believe you have violated these Terms, engaged in illegal activity, committed fraud, or posed a security risk.

Upon termination, your right to use the software ceases immediately. Local data remains on your machine, but the software application will no longer function for active sending.

13. Service Availability

While our local software is designed to run independently on your device, certain features (like license verification or updates) require an internet connection.

We aim to provide reliable services, but we cannot guarantee uninterrupted availability, error-free operation, or the continuous availability of the third-party SMTP or messaging networks the software relies on.

14. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Specifically, Senderwe does NOT guarantee:

• Inbox placement or successful email delivery.
• Successful WhatsApp delivery or immunity from account bans.
• Uninterrupted operation of third-party SMTP or messaging services.
• Specific business results, campaign performance, or conversion rates.

15. Limitation of Liability

To the maximum extent permitted by law, Senderwe and SYNTR.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.

16. Indemnification

You agree to indemnify and hold harmless Senderwe, SYNTR.AI, and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your misuse of the Services, your transmission of unlawful content, your violation of third-party rights, or your violation of these Terms.

17. Changes to the Service

Senderwe may update, modify, improve, or discontinue features of the software or website at any time. Material changes to the core functionality of purchased software licenses will be communicated where legally required.

18. Changes to Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated "Last Updated" date. By continuing to use the Services after changes become effective, you agree to the new Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
